Here would be the scenario: A person of the age of 19 is parked on the side of the road, lights on vehicle running looking for cell phone, an officer pulls up and asks what is going on? 19 year old explains looking for cell phone, officer notices empty beer cans in back of SUV for recycling (no alcohol has been consumed, confirmed by officers gave sobriety test). Officer asks if their is want to search vehicle, 19 year old makes it easy and gives officers marijuana, (non has been smoked, but did just purchase and has over 30 grams)......19 year old arrested, vehicle searched, cell phone search, Miranda rights read, offered lawyer, but not legal aid, answered questions, let go with a ticket for open alcohol and possession with only a fine........2 weeks later officer phone his residence looking saying he made a mistake, his superiors are upset and he is getting heat, so charges are pending..... can they actually charge some one after the fact?
